North Carolina vs. South Carolina workers' comp: what brokers need to know
The two states share a border and a metro area, but their workers' comp systems differ in ways that change a placement.
Coverage thresholds. North Carolina requires workers' comp coverage for most businesses with three or more employees (with carve-outs for certain agricultural, domestic, and sawmill operations). South Carolina sets the threshold at four or more employees. A small contractor straddling the state line can be mandatory in NC and exempt in SC for the same headcount.
Administration. NC claims run through the North Carolina Industrial Commission; SC through the South Carolina Workers' Compensation Commission. Different forms, different filing deadlines, different dispute procedures.
Rating. South Carolina operates on NCCI's loss-cost system. North Carolina is a competitive-rating state where individual carrier deviations from the loss cost are common — so the spread between the cheapest and most expensive carrier for the same class code is usually wider in NC than in SC.
Owner exclusion. The forms differ — NC and SC each have their own owner/officer exclusion election, and an exclusion filed in one state does not carry to the other.
Underwriting appetite. Both states use NCCI class codes, but carrier appetite diverges sharply. A carrier may write NC roofing freely and redline SC roofing, or the reverse. Knowing which markets want which state is most of the value a local wholesale broker adds.
Lead state on multi-state Carolinas accounts. For a client operating in both states, getting the lead-state designation right matters for the interstate X-Mod calculation and for how payroll is allocated at audit.
